    Terms of Use

    Effective date: February 13, 2026

    These Terms of Use ("Terms") govern your access to and use of CX Pond ("Platform", "Service", "we", "our", "us"). By accessing or using CX Pond, you agree to these Terms and our Privacy Policy.

    If you do not agree, do not use the Service.

    1. Eligibility and Account

    • You must be at least 18 years old and legally capable of entering into binding agreements.
    • You must provide accurate account information and keep it updated.
    • You are responsible for activity under your account, including safeguarding login access.
    • You must promptly notify us of unauthorized use of your account.

    2. Service Scope

    CX Pond provides professional networking and community features, including (as available):

    • Public and private professional profiles.
    • Articles and content publishing.
    • Jobs discovery and posting.
    • Platform listings, reviews, and discussion forums.
    • Role-based access and approvals.
    • RFP workflows between requesters and responders.
    • Inbox, notifications, and related communications.

    Features may be added, removed, or modified over time.

    3. Acceptable Use

    You agree not to:

    • Violate laws or third-party rights.
    • Post prohibited content under Community Guidelines.
    • Misrepresent identity, credentials, or affiliations.
    • Interfere with platform security, availability, or integrity.
    • Use bots/scrapers/automation in ways not explicitly authorized.
    • Reverse engineer, exploit, or abuse API/feature behavior.

    4. User Content and License

    "User Content" means content you submit to CX Pond (profile data, posts, comments, reviews, RFP material, messages, uploads, etc.).

    • You retain ownership of your User Content.
    • You grant CX Pond a worldwide, non-exclusive, royalty-free license to host, store, reproduce, format, display, and distribute your User Content solely to operate and improve the Service.
    • You represent that you have all rights needed to submit the content.
    • We may remove or restrict content that violates these Terms or applicable law.

    5. Roles, Approvals, and Administrative Actions

    Some roles and features are role-gated and may require approval.

    • Role grants, restrictions, or removals may be applied based on policy, compliance, abuse prevention, or operational needs.
    • Admin decisions on moderation and access controls are final subject to internal review processes.

    6. Paid Features and Subscriptions

    Certain features may require paid subscriptions (for example, SaaS representative or premium capabilities).

    • Pricing, billing cycle, trial terms, and cancellation conditions are shown during checkout.
    • Payments are processed by third-party providers (e.g., Stripe) under their terms.
    • You authorize recurring charges where applicable until cancellation.
    • Taxes, chargebacks, and payment disputes may affect account access and feature availability.

    7. Jobs, Platforms, Reviews, and RFP Disclaimers

    • CX Pond is a facilitation platform and not a party to employment, vendor, procurement, or commercial contracts between users.
    • We do not guarantee the accuracy, legality, quality, or outcomes of listings, reviews, or RFP responses.
    • You are responsible for due diligence before hiring, purchasing, contracting, or sharing confidential information.

    8. Privacy and Data

    Use of personal data is governed by the Privacy Policy. By using the Service, you acknowledge that your information will be processed as described there.

    9. Suspension, Deactivation, and Termination

    We may suspend, restrict, or terminate access for violations, legal risk, fraud, abuse, security concerns, or operational reasons.

    You may stop using the Service at any time. Data retention and deletion timelines are handled per our Privacy Policy and internal compliance requirements.

    10. Intellectual Property

    All platform software, branding, design, and non-user content are owned by CX Pond or its licensors and protected by applicable IP laws.

    No rights are granted except as explicitly stated in these Terms.

    11. Disclaimers

    The Service is provided on an "as is" and "as available" basis. To the fullest extent permitted by law, we disclaim warranties of merchantability, fitness for a particular purpose, non-infringement, and uninterrupted availability.

    12. Limitation of Liability

    To the maximum extent permitted by law, CX Pond and its affiliates will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or loss of profits, data, goodwill, or business opportunities.

    Our aggregate liability arising out of or related to the Service will not exceed the greater of:

    • the amount you paid to CX Pond in the 12 months before the claim, or
    • GBP 100.

    13. Indemnity

    You agree to indemnify and hold harmless CX Pond, its affiliates, officers, and employees against claims, liabilities, damages, and costs arising from your content, your use of the Service, or your violation of these Terms.

    14. Changes to Terms

    We may update these Terms from time to time. The updated version becomes effective when posted. Continued use after updates means acceptance of revised Terms.
